Gerard Wm. Wittstadt, Jr. is an attorney licensed to practice law in the states of Maryland, West Virginia and the District of Columbia.
Mr. Wittstadt practices law in the area of Estate Planning and Estate Administration, Elder Law and Title and Real Estate Transactions. He helps individuals meet their estate planning goals. Mr. Wittstadt also helps families with special needs children, including trusts and adult guardianships, all at affordable and very competitive prices.
After graduating, with honors, from the University of Baltimore, School of Law in 1992 and successfully passing the Bar Examination for the State of Maryland, Mr. Wittstadt served his country, on active duty, from January of 1993 through July of 1996 in the United States Navy. During that time, Mr. Wittstadt served as appellate counsel for thousands of Sailors and Marines before the military appellate courts and the Supreme Court of the United States.
Mr. Wittstadt is an experienced trial lawyer who has achieved great success before juries, judges, and arbitrators. For much of his career, he focused his practice on complex business litigation, particularly in the areas of banking, finance and real estate. In addition, Mr. Wittstadt routinely represented real estate companies, brokers, banks and their servicers in complex business tort and contract litigation. His cases address a wide variety of legal issues including breaches of contract and fiduciary duties, fraud, RICO, TILA, RESPA, ERISA, and violations of various state and federal statutes. In his thirty-three years of law practice, Mr. Wittstadt has served as defense counsel in both civil and criminal matters, and plaintiff's counsel. He has tried more than 25 jury trials and represented clients in numerous federal and state appeals. Mr. Wittstadt served as a Lieutenant in the United States Navy Judge Advocate General Corps where, among other achievements, he was responsible for twenty-four published appellate opinions on military justice matters, including the highly publicized United States v. Kelly, 40 M.J. 558 ((N.M.C.M.R. 1994). Mr. Wittstadt has also filed for Writs of Certiorari in the Supreme Court of the United States.
From 2001 through 2016, while in private practice, Mr. Wittstadt has worked exclusively for law firms that represented banks in all aspects of the mortgage servicing industry. Mr. Wittstadt has personally appeared in Court on thousands of occasions, representing clients in contested trials, bankruptcy and administrative proceedings. He has conducted thousands of REO transactions and real estate settlements. During this time, Mr. Wittstadt acted as general counsel, supervising 80 attorneys and 400 staff members across 13 states, who reported directly to him on all aspects of litigation, including but not limited to discovery, motion practice; trial; and appeals. Since 2016, Mr. Wittstadt has operated a general law practice, where he regularly advises clients on real estate and business matters; election law; personal injury; and estates and trusts matters.
Mr. Wittstadt is a litigator. He has appeared before many different trial and appellate courts, including the Supreme Court of the United States, having filed two Writs for Certiorari. Mr. Wittstadt has personally tried hundreds, if not thousands of civil cases.
